Chapter 13 cases are usually used by people who are behind on their mortgage or car payments. Chapter 13 allowed them to keep their property while paying off the past due balance over a period of time. Chapter 13 is also used by people who have too much equity in real estate or personal property to exempt, for example, someone who owns a home with no mortgage. The person might have to turn over the home to the trustee if a Chapter 7 was filed. Chapter 7 cases are simple as far as what you are expected to do. We need to meet and prepare your schedules for filing. You take your pre-filing course and your post-filing course and we meet with the trustee. After we meet with the trustee and you complete your post-filing course, the case is over for 98% of people. If you are in the other 2%, I would convert your case to a Chapter 13.
