Whenever we need help, John O'Brien responds quickly and completes all tasks on time. Unfortunately, I had difficulty negotiating the use and occupancy agreement with the seller. There was no active effort on his part to resolve our problems. In addition, he did not provide us with the right advice regarding possible condo conversions. According to our current attorney, this issue should be addressed properly during the purchase and sale process. I think it's more important to note that he spelled the buyer's name incorrectly on the deed, and it took me around 2 months to get an affidavit of scrivener error to resolve the issue! Due to his failure to convince the seller's attorney to sign a corrected deed, he was unable to obtain a new deed with the correct spelling. Consequently, I only had his affidavit of scrivener error to go on!

My goal is always to work in the best interests of my clients, in this case, at the time I was contacted by the client, they already had an offer accepted and I was to negotiate the Purchase and Sale agreement. As part of the accepted offer, the Sellers were requesting a Use and Occupancy agreement which I completed with no issues and to the client's exact requirements. At no time was the mention of a condo conversion brought up during that conversation, nor would it have been as a conversion of a property has nothing to do with the sale of that property unless it was a condition of the offer. Since this was not the case, a condo conversion would be something that is done after the purchase of the property and does not pertain to the P&S, contrary to what their current attorney stated. Lastly, the Seller's attorney misspelled the name on the deed and the Affidavit of Scrivener's error is sufficient for all future transfers of property according to the Massachusetts Real Estate Bar Association Title Standards. This was explained to client and she accepted and agreed to that document.
