I hired this LDA for assistance with an appellate filing and paid a $600 deposit.
She told me she would have the required form ready by 2pm, but when I called at that time it was not prepared. Due to the time-sensitive deadline, I completed and used my own draft.
I personally drafted both the Civil Case Information Statement (APP-004) and the Designation of Record. When I asked questions about certain sections of the Civil Case Information Statement, she indicated she was unsure about some responses and stated that if anything was incorrect, the court might allow it to be corrected later. After filing, the court rejected the document and required corrections, which I handled myself.
While she prepared and served the Notice of Appeal, I completed the substantive drafting and managed the appellate record filings independently.
The level of service provided did not meet my expectations, and I chose not to proceed with the remaining services under the agreement.
For a time-sensitive appellate matter, I expected more proactive preparation and substantive review. I recommend clearly defining in writing what “assist” includes before proceeding.
