I hired Mr. Brian Frees to serve as federal counsel for my son in a federal case in Utah. Unfortunately, Mr. Frees did not file the necessary paperwork to establish his role as my son’s federal attorney, despite multiple requests and follow-ups. Both I and my son’s public defender attempted to prompt Mr. Frees to take the appropriate steps, but after two months without action, my son ultimately accepted a plea deal facilitated by his public defender.
Following the plea, I continued reaching out to Mr. Frees, asking him to contact my son in federal prison to ensure that any warrants or issues were addressed prior to his release. Mr. Frees assured me several times that he would make contact, but even after a year, my son has not received any communication from him.
Given the lack of follow-through despite payment for his services, I am now prepared to file a formal complaint with the bar association. I feel it is important to bring attention to Mr. Frees' unprofessional conduct in this matter.

What is your typical process for working with a new customer?
Typically - I discuss the case with a potential client over the phone or at my office. After the client has determined they would like to hire me I arrange a payment plan that works for both of us. I always want my clients to have the Attorney of their choosing and offer very flexible payment plans for that reason. After the client has signed the Retainer paperwork and payment has been received I start working on their case. Usually filing paperwork with the court and prosecutor to notify I am the attorney on the case and demand they turn over the discovery in the case.
