We hired Deb Mansion for some minor remodeling/ renovation work in our office. Deborah Flores' first visit was very professional. She had a list of jobs with her based on our phone conversation and approximate measurements provided. She took photos of the site and made some sketches. Then she sent a proposal for review. As we have 4 decision makers, we made changes to our original plan of action and revisions were signed off by the management. To my regret, I found that she started making changes onsite based on suggestions from the staff and anyone who walked by. We told her not to take into account any verbal suggestions made by any staff on the property and that changes can only be authorized by the Project Manager or on-site supervisor. Deb Mansion severely exceeded the time limit set on the initial jobs, like the renovation of a bathroom and the plumbing for a new bathroom, which was delayed indefinitely at the time for a 2 SF piece of glass with 2 holes to support vessel sinks. Our conference room wall had been taken down but the shipment of glass panels was delayed indefinitely. So the room remained unusable with dust and debris everywhere for weeks, endangering the health of our staff. The contract was revised once to add one job to take down a wall to join two offices which would significantly improve our operations during the fast approaching high season and to postpone certain cosmetic work, unimportant at the time, such as stonework and a water feature on the main lobby wall, elevator renovation, repainting of baseboards and doors, change of acoustic ceiling to flat ceiling, etc. Deb Mansion assured us that all the jobs would be completed within a 3 week period. The back office was to be completed over a weekend but Deborah Flores cut down on labor, doing the job herself and requested the help of our handyman to finish the job. This resulted in this 1 or 2 day job taking over 2 weeks during which the operations of one division was halted. In our seasonal business, the busiest time of the year is mid-March to mid-August and there was no indication of Deb Mansion completing all the jobs within the promised 3 week period. The glass panels for the conference wall was required to be 1/2” thick, which is standard thickness for tempered commercial grade glass. As Deb Mansion’s agreement with the first glass company fell through, Deborah Flores got quotes from some other glass companies who came to our office for measurements. It became clear that when Deborah Flores realized that she had under quoted us, she started to cut corners and got a friend of her brother’s to install panels of minimum thickness of 3/8”. The thickness was not included in the contract but verbally committed to both, the project manager and the on-site supervisor. On April 7, 2016, Deb Mansion provided us a hand written calculation/ invoice in the amount of $3,608.15 including $908.15 worth of receipts from Lowe’s and Home Depot for various items. We requested Deborah and Wesley for a description of these items as it was impossible for us to know what they were from item codes/ technical product names/ product codes/ SKU numbers. We were responsible for purchase of only a few large items like a urinal, sinks and mirrors, per the contract. Most materials were included in Deb Mansion's quote so it was necessary to obtain a description of the receipts. We had not refused to pay for any of the completed jobs and we have records of paying Deb Mansion three times in advance for jobs to be undertaken in the following weeks. We only requested before final payment that all jobs be completed to a satisfactory level as stated in the contract. On April 22, 2016, a detailed report of issues/ grievances regarding the poor finishing of jobs, noncompliance with the agreement, approved drawings and/ or images, and a number of related concerns was presented to Deb Mansion during a post completion inspection to Deborah Flores’s son, Wesley Samuel Valentin Flores (“Wesley”), who had also worked on some of the jobs, as Deborah Flores was indisposed (scheduled for surgery as notified by text). After the walk through and receiving a copy of all the concerns with their work, Wesley commented to the effect that they were just minor finishing issues that are not noticeable during major construction/demo work with all the debris lying around and that they could all be taken care of by end of day. Wesley returned later that day with supplies to take care of these finishing concerns, but Deborah Flores interrupted him, shouted at him to stop and created a scene in our office, threatening to file a lawsuit. When Wesley left the premises that morning he verbally threatened us that he would “deal with” anyone who messed with his mother. After that day, we instructed Deb Mansion that their employees were not to return to the premises and that incomplete jobs would be taken care of at our expense, in order to prevent work disruptions and avoid any hostility. After Wesley and Deborah Flores’s last visit, the toilet clogged 6 times over the next 4 days due to concrete and debris found in the pipes by outside labor we hired. Deb Mansion did not meet the contractor’s responsibilities (satisfactory job completion) and exceeded the deadline by 1 month. Due to not having enough employees for labor and having to subcontract many plumbing and electrical jobs to substandard professionals who did many things incorrectly, Deb Mansion may have incurred financial losses to get jobs redone because of Deborah Flores’ lack of knowledge, required skills and team to operate such a business. All projects were to be completed by March 22, 2016, per the contract and despite cancelling many of the jobs, the 2 bathrooms and conference room were completed 1 month past the deadline on the contract on April 22, 2016, to a far below satisfactory level. Deb Mansion was required to provide references for previous jobs, contractor license and certificate of insurance before starting the project. None of the above had been provided till the day we asked them to no longer enter our premises. Despite, Deb Mansion’s noncooperation regarding the completion, deadlines and finishing of undertaken jobs, our company had not resorted to legal procedures. Then we were informed by mail that Deb Mansion was going to sue us for non-payment of those receipts and the last 5% of the payment. We were not going to be bullied by their attempt to scare us out of more money. Our legal team informed Deb Mansion that we would seek compensation for noncompliance with contractor responsibilities per the contract, noncompliance of providing contractor license and/ or certificate of insurance leaving us liable for injury/ accidents, delays in completion of multiple projects, creating a nuisance at a workplace, losses incurred due to inability of 7 staff members to work for 2 weeks due to delays in back office renovation that was to be completed over 1 weekend, interference with the air conditioning unit resulting in air conditioning issues for 3 weeks in an office with 25+ employees as summer was approaching, losses that would be incurred due to legal procedures during aforementioned busy season, and losses that will be incurred for fixing their poor plumbing/ paint/ ceiling/ tiling jobs, etc. We haven't heard back since.
