Q & A

Answers to commonly asked questions from the experts on Thumbtack.

How do you find a bankruptcy attorney?

You’ll need to conduct a little bit of research to find the best bankruptcy lawyer for your situation. Start by pulling up a list of attorneys near you. Identify a few lawyers who have high ratings, mostly positive customer reviews and the required credentials in your state.

Once you have a list of three to five potential attorneys you can hire, figure out how much they charge. Ask for a free cost estimate (what are their hourly rates?) and ask them to explain their fee schedule. Choose an attorney with a solid track record and reputation, fair pricing and the right credentials.

How do lawyers get paid if they lose a case?

Lawyers typically charge for their time (typically a hourly rate) regardless of whether they win a case. Sometimes, the losing party is ordered to pay the other party’s lawyer fees on top of their own. Some lawyers also work on contingency, meaning they will take a percentage of the awarded amount only if they successfully win the case.

Before hiring a lawyer, make sure you understand their fee structure.

How do you file bankruptcy without an attorney?

It’s possible to file bankruptcy without a lawyer’s help (which is called “filing pro se”) — but consider the pros and cons before you do. The Administrative Office of the U.S. Courts strongly recommends you get advice from an attorney because of the “long-term financial and legal outcomes.”

What does a bankruptcy attorney do?

A bankruptcy attorney helps individuals and corporations navigate the legal and court process of going through bankruptcy. They’ll explain the process to you, help you fill out forms, advise you on which chapter you should file under and more.

My husband and I had an urgent bankruptcy matter from another state that needed attending to in a short time frame. The attorneys were quick to respond, answered all our questions, assisted us in our next steps and addressed all our concerns. Our experience has been highly positive and would recommend to any of our family or friends.

I hired Derek Prosser two months ago. At first he was going on vacation, so when I finally went to see him in person, in he said he did absolutely nothing so far due to that. We sat there for about 15 minutes and he filled in my creditors. Then he told me he needed more information and he could work on my bankruptcy. I got him the information he needed and had not heard anything for 3 weeks. I finally asked for a refund since my mother got hit with hurricane Irma and had an issue with a pet, since she paid by credit card and was very angry with me that I hired such a bad attorney, that we were both losing money since now I am paying her back and still not getting this man to finish the job. He offered to give me $200 dollars back when I asked and was very rude. Sorry but $600 was the majority of the filing fee for bankruptcy and then I would make monthly payments after for his services for additional $900 and that if I did not pay they would just become a creditor and submit themselves to the bankruptcy court. Once I heard that I said "you have not done any work as you told me and now want to keep $400 dollars?" Sorry but 15 minutes is not worth 400 dollars unless you are some high dollar civil defense or criminal attorney that bills out 1k an hour. I told him in an email from the beginning who my creditors were and that I am on chemo and wanted this to be easy. He said it was a simple chapter 7 but this is not the case. If it was so simple he would have filled something or had me back in there to finish this all up. I still get no replies or a resolution to this matter. I would avoid this if possible.
