We contacted Chris Rogers in the spring of 2013 to review our circumstances for a possible bankruptcy case. I spoke to quite a few attorneys before deciding to meet with Chris. When we met in person, Chris was compassionate and non-judgmental as he walked us through the steps of a Utah bankruptcy. My husband said he was most impressed with his confidence and Chris' ongoing communication about the upcoming deadlines and documents necessary for each step. It is necessary to complete quite a bit of paperwork to provide a current financial picture when filing bankruptcy. Some of the forms were very confusing. Chris was exceptionally patient when I had occasion to call to ask for guidance. He is knowledgeable about the limits, maximums, minimums of specific categories of debt and income. When we appeared before the bankruptcy court in the summer of 2013, Chris respectfully but confidently corrected a couple of errors in the judge's understanding of our case. The bankruptcy was granted a couple of months later. The fees charged by Mr. Rogers were reasonable considering our case had tax implications in another state as well as federal taxes. Chris helped us start a new financial path and encouraged us to respect and try to improve our financial health moving forward. I tell people not to try to handle big issues like bankruptcy by themselves when they think they can't afford to hire an attorney or they have the knowledge to do the paperwork themselves. Chris made it manageable for us AND because his services are within our financial reach, we are moving forward to resolve a few additional issues which are outside of the bankruptcy. In fact, we are meeting next month. As with the bankruptcy, we can see a light at the end of the tunnel with these other issues as well, thanks to Chris.

Have you been sued to collect a debt, or are you being harassed by debt collectors? If so, the debt collectors may owe you money. It is surprising how often debt collectors violate the law. Debt collectors, as defined by the Fair Debt Collection Practices Act (FDCPA), must follow strict requirements when trying to collect a debt from a consumer. Debt collectors can't just use any tactic they choose to collect a debt. You may have a good legal case to collect money from a debt collector if the debt collector uses illegal tactics, including the following: (1) calls you outside the hours of 8:00 a.m. to 9:00 p.m.; (2) calls you after being informed that you are represented by an attorney; (3) uses false or deceptive means to collect a debt; (4) causes your phone to ring consistently; (5) fails to send written notice within 5 days after the initial phone call; (6) solicits post-dated checks more than 5 days from the written date; (7) threatens to illegally take your property; (8) threatens to file a lawsuit against you when the debt collector is not an attorney; (9) attempts to collect fees or interest that are not set forth in your credit agreement; (10) fails to accurately identify itself; and (11) uses any of several other prohibited debt collection practices. If the debt collector violates the FDCPA, which happens frequently, the debt collector can be required to pay money damages for the violation. If the debt collector violates the FDCPA, you may also be able to cancel your debt through a settlement.
