Introduction: I have been mediating cases for over fourteen years. In that time I have mediated over 3,000 cases including court ordered cases for the counties of Arapahoe, Denver, Douglas, Elbert and Jefferson counties.
Areas mediated include but are not limited to county & district civil, domestic relations, employer/employee and real estate disputes. Private mediations run the complete gambit of dispute resolution.
Most cases can be mediated in a couple of hours. Many mediations (over 65%) result in the parties reaching a stipulation which eliminates the need for the parties to go to trial.
While it is not my role to resolve your matters, it is my role to guide through the process of determining if there is a appropriate resolution which avoids the need for litigation or a trial.
As a mediator I do not make any decisions but rather help keep the conversation moving.
On a few occasions I have arbitrated a case to resolution for the parties. I am a neutral which means I do not take sides.
On many occasions I have had parties come to mediation starting out by informing me that there is no way a resolution can be reached.
After discuss with the parties I have had the satisfaction when both sides carve out a resolution, which may not make them totally happy, but that leaves them satisfied enough that they don't need to further litigate their case or have a trial.
REMEMBER that as a mediator I don't make the decisions, you do. As an old attorney friend has told me many times, when both parties are a little unhappy you probably have a fair resolution.
