STRATEGICALLY CREATIVE AND COMPASSIONATE I first came to Brian back in 2001. My two school aged daughters and I had fled from their biological father in another state. I had gotten a fast divorce prior to leaving that state, but there were many things that needed clarification. The first order of business was to obtain Protective Orders. Brian and his brilliant staff took immediate control. They secured Protective Orders which was hard to do given the fact that my ex-husband needed to be served in Texas. He didn't live in Texas. Still, through creativity and coordination by Brian and his staff, Protective Orders were secured. Next came cleaning up my swift divorce obtained in the state from which my children and I previously resided.. Getting the divorce moved to Texas presented another challenge and until that happened, nothing could be done to change anything about it. Not only was most of it ambiguous, but it was detrimental to my children. Again, through careful coordination, Brian and his staff got the divorce moved to Texas and then made changes which further reinforced our safety and security. I soon married a loving man who became a fabulous father to our daughters. Shortly following that, we had another baby girl. Thus making us a happy, busy, and complete family. There have been years of laughter and love. FAST FORWARD 12 YEARS In May of 2013, tragedy struck our idyllic life. Our eldest daughters had just returned home from their respective colleges when my beloved husband suffered a fatal heart attack right before our very eyes. It was fast, sudden and devastatingly shocking to us and everyone who knew him. He was a healthy middle aged man with no prior diagnosis relating to heart disease. His friends and colleagues are still very sad. Our daughters and I are still grieving. He was an amazing man. Our daughters who were ages 22, 21, and 11 lost their Daddy. As if that wasn't enough for us to bear, another problem resurfaced. My husband's former wife from many years ago, with whom he had no children showed up the night before his funeral with a lawyer and her divorce decree. Up until that evening, this lady was a stranger to us. We were aware of her existence, but had never before met her. This lady was making claims to survivor benefits. She had even called my husband's employer, falsely insisting that she possessed Court documentation which entitled her to his benefits. This stirred up much confusion and trouble. It was time to call Brian again. We had probate attorneys handling the estate. Still, costly delays and difficulties were created due to the assertions made by my husband's former wife. One of her claims, in particular, was to one of our 401k Savings Plans. This lady asserted that she had a QDRO awarding her a portion of his retirement. In fact, she did not. Under the Texas Family Law Code, she had two years following the finalization of their divorce to not only obtain a QDRO, but to submit it for approval and her award. This was never done. At first, most legal professionals thought she was out of luck. Cased closed, right? Wrong. Up until recently before my husband's tragic passing, Federal Law, ERISA, prohibited a QDRO from being drawn up, much less submitted after the Plan Participant dies. However, this law had changed so recently that it wasn't yet in the books of the Texas Family Code OR even yet written into the 401K Plan guidelines from my husband's employer. The law NOW permitted a QDRO to be drafted, signed by a judge, and submitted to an employer's 401k Plan Administrator for approval OR rejection. Given those circumstances, my probate attorneys were advising me to just settle without trying to fight it. Brian and his now partner Jake Gilbreath said, "Not so fast." They spent some time researching, discussing and preparing our argument to 1)Not grant the QDRO. Among some of the reasons given were:They(ex-wife and attorney) had drafted a QDRO which did not coincide with the orders on the decree. It is not possible to change orders to a finalized decree after one party has died. Plus the time frame for the ex-wife to implement her claim(2 years) had long ago expired BEFORE this law had changed. 2) Brian and Jake also sought an alternative, should the judge see fit to sign a QDRO. In our proposed alternative, Brian asked that the QDRO be drawn up to match the decree. Given the QDRO guidelines set by the employer from The 401k Plan they were seeking, it was unlikely that the signed QDRO, would be approved. They could not draw up a QDRO which matched the decree and, at the same time, meet the requirements set forth by the employer. During the hearing, the judge made it clear to our opposition that she would only sign a QDRO which stated the exact language used in the orders of the decree. So, a new QDRO was drawn up by both sides, small adjustments were made by the judge before she signed it. The QDRO was sent and reviewed by the legal team who handles 401k's at the company with whom my husband had once been employed, it was REJECTED. This lady from my husband's past failed at her attempt to take such assets from his grieving family. Even with case law on her side, Brian and Jake were strategic in their timing and were well prepared.
