In addition to serving the full slate of traditional estate planning goals (e.g. making a will to say what happens to my stuff when I die; naming a person to help me with my finances using a Power of Attorney, etc), my practice has as a particular focus protecting families and assets from extraordinary expenses associated with long term care. This includes pre-planning to protect assets from long nursing home stays and crisis planning when a person is already in a nursing home, or about to need such care. I am also accredited by the Department of Veterans Affairs to assist veterans and their families in understanding and accessing their benefits. My practice makes a particular effort to assist wartime veterans and their spouses in obtaining what is called "Improved Pension" or "Death Pension," which can help a person when they need the "aid and attendance" of another to supplement their care. We're not a society that talks frankly about the costs associated with aging and having increased care needs. People come to me concerned that they could lose everything if they or their spouse becomes ill. Sometimes a person's adult child will come to me for advice on how to help "dad" access the care they need, while still leaving something for "mom," who is relatively healthy and able to live independently. My job is most fulfilling when I can see the strain and anxiety that these concerns create start to lift as people learn that there are options. My best days are when we help someone obtain a VA pension benefit, or a Medicaid application is approved, and a spouse or child can worry a little less about the finances, and just focus on the emotional and other needs of their loved one.See more

FAQs

Answers to commonly asked questions from the experts on Thumbtack.

Hourly rates for bankruptcy attorneys range from $200-$300. In total, customers spend an average of $999-$1,183 for their services. But because lawyers have different fee structures, you should always ask for an estimate from several bankruptcy attorneys in your area before hiring one.

You’ll need to conduct a little bit of research to find the best bankruptcy lawyer for your situation. Start by pulling up a list of attorneys near you. Identify a few lawyers who have high ratings, mostly positive customer reviews and the required credentials in your state.

Once you have a list of three to five potential attorneys you can hire, figure out how much they charge. Ask for a free cost estimate (what are their hourly rates?) and ask them to explain their fee schedule. Choose an attorney with a solid track record and reputation, fair pricing and the right credentials.

Lawyers typically charge for their time (typically a hourly rate) regardless of whether they win a case. Sometimes, the losing party is ordered to pay the other party’s lawyer fees on top of their own. Some lawyers also work on contingency, meaning they will take a percentage of the awarded amount only if they successfully win the case.

Before hiring a lawyer, make sure you understand their fee structure.

It’s possible to file bankruptcy without a lawyer’s help (which is called “filing pro se”) — but consider the pros and cons before you do. The Administrative Office of the U.S. Courts strongly recommends you get advice from an attorney because of the “long-term financial and legal outcomes.”

You can find bankruptcy attorneys near you on Thumbtack. Start searching and comparing potential lawyers to hire.

A bankruptcy attorney helps individuals and corporations navigate the legal and court process of going through bankruptcy. They’ll explain the process to you, help you fill out forms, advise you on which chapter you should file under and more.
