The reasons mediation should be your first option versus litigation:
In disputes between two or more parties, consider the concept of mediation as the first and best option prior to committing to litigate. For instance, one can ill afford to live with the stress that surrounds the litigation process. Additionally, the negative effects experienced before, during and after the litigation process may last a lifetime. Stress of this magnitude may contribute to health problems, sleep disorder, and consume cognitive ability. The cause and effect experienced from a significant negative event can contribute to additional negatives to a theoretical infinity, unless the stress surrounding the event is addressed correctly.
How does the process work? A neutral party will guide your mediation. The resolution process is about you and fixing what is broken. If your automobile's engine were in need of repair, would you take it to a brake specialist? Thus, in every problem we encounter in our lives, whether it is a broken car or non-functioning air-conditioner we find the right person to facilitate the repair. Similar to a bricklayer learning that he or she is unable to execute their craft without mortar, trowel, and devoid of a finely tuned skill set, any mediator's effectiveness within the mediated process directly correlates to the quality and quantity of his or her resolution tools. Moreover, they need to be easily accessible and interchangeable to achieve the correct result. In a similar context, I earned an advanced degree in Conflict Resolution and Reconciliation from Abilene Christian University (ACU) in Abilene, Texas to gain a diverse and well-rounded solution oriented skillset.
The highly regarded ACU conflict resolution program, coupled with a diverse set of life experience combines into a powerful set of conflict resolution tools. Thus, I can use traditional and cutting edge resolution methods with a dash of creativity within any mediated process. In complement to the process, the parties will be encouraged to find a compatible, workable, and fair resolution to their conflict. As I explained, this process is not about me, but it demands that I know what I am doing for your benefit. Thus, I will continue to educate myself academically to increase that benefit. In the same context, I have also acquired certificates in Conflict Resolution, Mediation, and Advanced Mediation of Marital Disputes from the Duncum Center for Conflict Resolution and ACU, which serve to strengthen my overall skill set. I can approach and nullify conflict in a variety of ways, but I will continue to improve this part of the process. I can address problems and issues associated to conflict from a religious, spiritual, biblical, or secular perspective, but I will always try to improve this part of the process.
However, it is important to highlight that I have a broad set of experiential knowledge that I can call upon. For instance, I have successfully nullified conflict associated to approximately one-hundred individual real estate transactions. However, much the same as in everyone's life, this experience represents a single color to a multi-dimensional spectrum of colors that combine into experiential knowledge. Nevertheless, I have many tools that I can call upon to achieve the best result, which in my perception is a successful resolution and lasting peace.
