Raushanah Rodgers collected on a bad debt for us. She handled everything from the beginning to the end. First she took the defendant to court, established that he owed us, and got a judgement.The defendant didn't want to pay, so Raushanah took him back to court and got an agreement to make payments with a provision that he forfeit certain assets to be sold at auction if he were to default. The defendant signed this agreement. After making a couple of payments the defendant defaulted and Raushanah asked the Sheriff Department to act on the order. The Sheriff Dept. refused to do this because they felt that they would be liable for cutting the lock, and because they didn't have specific VIN numbers for the assets, although the vehicles were named (but not by specific vin #. Raushanah worked through the process to convince the Sheriff's Dept. that not only had the court authorized the cutting of the lock and the seizure of the assets, but the defendant had agreed to it as well, by virtue of her agreement with him.The Sheriff subsequently cut the lock and had the vehicles towed. The defendant immediately went and paid the tow fees plus the amount of the judgement owed. It was a complete success in the debt collection dept. Within days after the defendant got his vehicles back, the Sheriff went and seized them again for the benefit of another creditor who had a judgement. I believe that Raushanah set a precedent in Durham for the seizure of assets to the benefit of creditors. The timing of the subsequent seizure to that of our own, after a complete failure to do so previously, seems to indicate that the Sheriff Dept now feels comfortable in fulfilling court ordered seizures.
