How much does it cost to hire a divorce lawyer?

The average cost to hire a divorce lawyer is roughly between $175 to $325 per hour. However, your costs may be higher or lower — it depends on several factors. For example, an uncontested divorce may cost less than a contested divorce.

How do I hire a good divorce attorney?

It’s important to spend an adequate amount of time researching and vetting several divorce attorneys before you hire one. Start by searching for top-rated lawyers near you, and read through their clients’ reviews. Get an idea of their reputation, how successful they are and how they set their pricing.

Make sure each attorney you’re considering is admitted to the bar in the state where your divorce could be adjudicated (ask your prospective lawyer first if you aren’t sure which state is right). And when you feel like you have a good list of potential divorce lawyers who can handle your case, contact them to get price estimates, their hourly rates and any other pricing terms.

What do lawyers do in a divorce?

A divorce lawyer handles negotiations regarding how assets are divided between spouses, as well as who assumes debts. The divorce lawyer can also help establish an agreement for child support and child custody between the spouses. All of this requires research and evidence gathering, as well as compiling and filing paperwork with the court that summarizes the evidence.

When should I hire a divorce attorney?

You should hire a divorce attorney in situations where settlements are hard to reach between you and your spouse, or if you want to better understand your rights. This includes a wide range of complicated issues, with common examples being:

  • Child custody and child support
  • Debts owed
  • Future assets like inheritance
  • Current assets like houses, cars and valuables

You should hire an attorney if you and your spouse are having difficulty agreeing to terms on how to handle these issues.

Who pays for a divorce?

Often, each spouse pays their own respective lawyer’s attorney fees and costs during a divorce. However, certain circumstances may lead to one party paying for the other’s legal fees.

Do divorce lawyers work on contingency?

It’s unusual for divorce lawyers to work on contingency, where they receive an agreed-upon proportion of the awarded amount if and only if they win the case. It's much more common for lawyers to work on a retainer or on a fixed hourly fee. Always discuss the fees and payment options with lawyers you’re considering hiring.

How do lawyers get paid if they lose a case?

Lawyers typically charge for their time (typically a hourly rate) regardless of whether they win a case. Sometimes, the losing party is ordered to pay the other party’s lawyer fees on top of their own. Some lawyers also work on contingency, meaning they will take a percentage of the awarded amount only if they successfully win the case.

Before hiring a lawyer, make sure you understand their fee structure.

This was such a disappointing and frustrating experience, I dont even know where to start. I hired Keith to handle my divorce, which he promised would take 2 months from the day he filed the papers. We started our business relationship early May 2021. I paid him just under $2000 - $300 for the filing fee and the rest to handle the divorce completely as I have some serious PTSD from the relationship with my abusive ex. I didn't mind paying extra to sever the ties without having to hear his voice again. Part of the process for me specifically was I needed help getting some information from my ex so I could file my tax return for 2020. Keith said he would handle it, and I even specified multiple times when my tax deadline was. I also explained how damaging talking to my ex would be as I had been making a lot of progress with my mental health journey. Keith was so hard to get ahold of that I ended up having to call my ex two days after my extension deadline with the IRS and get the info for myself. My night terrors were much worse for WEEKS. At this point, when I finally did get a hold of Keith I asked if he would be able to handle the rest of my case in a timely manner and I told him that if my case was too much or if he was too busy I would rather him just let me know so I could find another lawyer. Keith gave me many excuses but he assured me that he could finish the process quickly and if I just gave him another chance we could get it taken care of. We struggled along for another month or so and I finally asked for a partial refund. He returned 750 to me, explaining that the $300 for the filing fee would be non-refundable. HE ALSO LET ME KNOW THE PAPERS HAD NOT EVEN BEEN SERVED YET. After 6 MONTHS he STILL had not even FILED THE PAPERWORK!!!! This was before Thanksgiving. Fast forward to now, I have not heard from Keith in months. The number he gave me goes straight to voicemail, he doesn't answer any emails at all and I have no other way to contact him. I want the rest of my money back so I can at least have a chance at starting over with another lawyer who will take me seriously and appreciate the severity of my situation. PLEASE DO NOT WASTE YOUR TIME, HE IS A CON AND A THIEF. YOU WILL LOSE MONEY AND THE TIME ON YOUR CASE.
