How do lawyers get paid if they lose a case?
Lawyers typically charge for their time (typically a hourly rate) regardless of whether they win a case. Sometimes, the losing party is ordered to pay the other party’s lawyer fees on top of their own. Some lawyers also work on contingency, meaning they will take a percentage of the awarded amount only if they successfully win the case.
Before hiring a lawyer, make sure you understand their fee structure.

I want to be very clear - this review is not based solely on the one day that Scott and I spent at the courthouse for my divorce trial. This review is primarily based on the 5 weeks that I hired the Kosner firm to work with me up until the trial date. My experience with his staff was not pleasant. I found the only staff member I ever worked with (Stephanie) unprofessional, uncommunicative and rude. She outright refused me any contact with Scott. Scott is responsible for the actions of his staff and the service that his employees provide. They also reflect upon his law firm. I attempted many, many times to work with Scott directly, but was denied. Scott himself wrote me an e-mail after I wrote this review and said that he cannot give ‘limited scope’ clients the same service as his full time and/or retained clients. It is true – I did receive limited service. I would not have hired him for my trial had I known of this very limited support beforehand.
I hired Scott in 7/2018 for my divorce trial. Our initial 'free' consultation was brief, done while he was driving. He seemed very friendly on the phone, so I hired him and paid him to represent me at my divorce trial in August. However, I was unaware that I would neither meet him nor have absolutely any communication with him prior to the morning of the trial. I would not have hired him if I knew that. I will not go into detail about the actual trial itself, only a brief outcome as I will not get into the legality of what happened on the day of the trial.
Scott left on his vacation the very next day after our phone consultation and did not return until the night before my trial. I never met my own attorney. I had no idea who was managing my case. I was not kept informed or updated as to the status of my case. I was very shocked, disappointed and regretful. Scott arrived at the courthouse the morning of the trial and we met in person. He had a trial brief and an exhibit list that I had not been able to see prior to that moment. I was never given a copy of the documents that I hired and paid him for.
The first trial date scheduled for August was postponed by the judge 4 weeks until September. I was relieved to know that at least now I could actually work and communicate with the attorney I hired for my divorce case. However that too never happened. I was never contacted by Scott the entire 4 weeks leading up to my trial in September. I tried to contact Scott many, many times via phone, text, e-mail, etc. I was not permitted to speak with him by his staff member Stephanie. I had to drive 30 miles to their office in Los Angeles to request a brief meeting with Scott to provide even more paperwork. I complied. I, myself supplied all of the paperwork to his staff.
Scott promised to have all of our documents to the court several weeks before the trial, however they literally arrived to the courthouse only days before the trial while his secretary and I scrambled to get it done. I received a letter from the courthouse afterwards that the faxes and/or scans his office sent were unreadable and rejected. The first time I saw the brief and exhibit list was actually the morning of the trial. When the judge asked for images of our truck I had provided to Scott, they were not in the exhibit list. My Ex was not served with the exhibit list either (which turned out to be an issue). I did not feel like a valued client. I was frustrated and confused how this could happen from a law firm with such good reviews from this and other websites.
Long story short, I am still in court battling the same issues handled by Scott at my original trial last year. Although my Ex was not granted a ‘completely new’ trial this February, all but 2 issues have been re-opened for litigation and I am still in court now with a new attorney on those issues. It has been 11 months since I worked with the Kosner firm and I have already been back to court 4 times this in 'short cause trials" to re-litigate the same issues Scott thought he resolved when I hired him for the trial. I reached out to Scott for further assistance last November, however, not surprisingly he did not reply. I now have an exceptional new attorney that I have spent countless hours with.
After the 2018 trial was over, I was asked by Scott to submit some ‘positive’ reviews. I did write him a review on AVVO, however I also provided feedback directly to Scott alone regarding the negative experience I had with his staff and how it reflects poorly on his law firm. Not surprisingly, I never heard anything back from him. I have now been strongly advised by Scott to have all of my 'less than perfect' reviews pulled from multiple websites. My experience with the Kosner firm as a whole was unpleasant and my voice was not heard. As a previous, paying client, my voice DID and still DOES deserve to be heard. That is why these platforms exist to voice our opinions. We are not obligated to give only positive reviews. Just OUR reviews.
