A few weeks ago, I originally posted on thumbtack for a webdesigner who could make a website for my podcast involving well known professional athletes or well known people. Oscar Johnson gave me a bid and was excited because he was fans of some of my guests on the podcast coming. I emailed him on Feb 7 requesting quote in writing. Oscar responded via email on Friday February 7 2020 1:30:20PM a quote. On Sat, Feb 8, 2020 at 9:32 AM I replied quering about two quotes dollar difference. Oscar replied to me on Monday February 10 2020 11:47:38AM it would include premium plugins and stated he would have the website completed in 7 days. This meant he guaranteed it would be done no later than February 17, 2020. On Monday February 10 2020 2:58:52PM Oscar sent me a follow up email asking for half up front and half on completion. On Mon, Feb 10, 2020 at 2:16 PM I sent a follow up email, and in case things like this happen, I specifically made points about web guys who promise the world. I also confirmed he (Oscar via email) stated he would complete the website in 7 days. I paid half the money down, and sent website login data. On Thursday, Feb 13, 2020 12:51PM I sent Oscar our first edited podcast for him to launch on youtube and our website he already agreed to do. Oscar affirmed he would update me that night. (Feb 13): “Ok. I got it and will look at it now. Will update you later tonight.” That is the last time I received any contact from Oscar. Ironically, the next day on Friday Feb 14, 2020 even though we had made an agreement on services, paid deposit four days previously, on thumbtack J&B Logos,Social Media, SEO, Web Design & PPC messaged me asking if I was still interested in their services!! After I already paid four days prior and Oscar stated they were already working on the project now gave me another red flag. Here is their thumbtack message sent to me Friday Feb. 14, which by the way I did not even read until the following week: "Hello, I just wanted to follow up and see if you were still interested in our services. I would also like to mention that we here at Johnson and Borgen are rated TOP PRO here on Thumbtack. If you want the best service and best result, please don't hesitate to contact us." That was very disturbing to me. After Oscar’s guarantee to finish the podcast website in its entirety by Monday, February 17, I have never heard again from Oscar. I informed Oscar via email and here on their thumbtack message, that Nonperformance law occurs when one party in a contract does not fulfill his obligations. I have contacted my banking institution and got my deposit refunded to me. Had they at least called me, emailed me to notify you were behind, or another project was taking time, I could have understood and worked with that. But like many other web designers, they pass these projects to someone they sub out to and look for another sale. In the case there was an emergency of some kind, I waited another 7 days before posting this review today. Of course this delayed my podcast to be launched I talked about to Oscar on the phone and via email and text messages. No excuse for this. And I never to this day heard an apology, excuse or any response to the emails, before firing them. UPDATE March 4 Oscar and his partner who have zero organization, actually tried to send me a bill today for finishing a website for me that they never started, never communicated with me, took 250 and never contacted me again. (I did get this reversed), and today they sent me an autobill for payment. This can almost be comical. Here is what I texted, and emailed, messaged her on thumbtack, and are now updating on their well deserved one star review: Oscar and your partner, I posted your well deserved one star review on thumbtack. I messaged it to you on thumbtack, I emailed it to you and made sure all channels were proper to communicate to you that you took a 250 deposit abandoned your project, and I gave you 7 days after you stated you would have it finished in case you had an emergency or something happened. I then fired you, and to show your bad faith in taking money for work you did not intend to do, I had it reversed back to my account. I am not sure if you both are unorganized, incompetent, or just plain unprofessional. Regardless, you can definitely claim all three. Feb 17 I gave you notice that I fired you and rightfully got my money back. Today March 4, no doubt through your attempt to autobill clients, you didnt even remove me as your client to bill, and just sent me another bill for $250: Balance $250.00 Unpaid • Due on Mar 11, 2020 Here is your thumbtack message sent to me Friday Feb. 14 after I hired you prior week and paid $250: "Hello, I just wanted to follow up and see if you were still interested in our services. I would also like to mention that we here at Johnson and Borgen are rated TOP PRO here on Thumbtack. If you want the best service and best result, please don't hesitate to contact us. " You stated 7 days to completion on Feb 10. Even though I already paid half, you then you emailed me and asked me if I planned to hire you? That is very frightening to realize you just hired someone who doesnt even have his client accounts correct. Today on March 4, 2020 you send me a bill payment due for another $250? Almost a month after I fired you for no work, and reversing my money you attempted to keep without any contact? I told you Nonperformance law occurs when one party in a contract does not fulfill his obligations. Nonperformance includes breaches of contract. A material breach of contract occurs when nonperformance causes harm to a party of the contract. Well, you better remove this immediately and dont send me another fake bill for work you did not do. I will also send this to you on thumbtack, and I will text it to you as well to make sure you receive this. I need you to confirm this asap. W
