Caneisha Howell failed to complete her job. She failed to complete the motion. She failed to file the document. Caneisha failed to deliver anything for 40 days and quit after 49 days after delivering a very incomplete and very rough draft--garbage. Even though Caneisha Howell reviewed my documents before issuing her invoice. I paid the invoice upfront and she refused to refund my money for failure to complete it. Caneisha claims she spent a lot of time research and reading. In other words, she didn't know how to write the motion and thought she could just copy stuff from the Internet and bluff her way through the job.
Caneisha Howell was hired to write a motion for summary judgment. Summary judgment motions are written according to the civil complaint filed in court. Caneisha was given a copy of the complaint and used it price the work.
The description of the work is in the invoice and reads: "Motion for Summary Judgment-includes notice, memorandum of points and authorities, declaration. File within 30 days-anticipate first and second draft prior to completion Client has provided documents to support Service includes filing and service (not motion fee to file)"
Caneisha was paid in full upon receiving the invoice.
Caneisha never finished the memorandum, never produced the exhibits for the memorandum, never finished the declaration, never produced the exhibits for the declaration, never provided a second draft, never performed the filing, never performed the service.
The invoice says complete in 30 days. After several reminders and 40 days (Oct 18 to Nov 27), Caneisha provided only a partial first draft of the memorandum without the exhibits, no notice, no declaration, and no exhibits for the declaration.
Caneisha missed additional commitments to deliver updates, and after 49 days (Oct 18 to Nov 27), I asked for my money back. Her response was to send me what she had done and quit. The motion was only a little further along than what she sent me nine days earlier but nowhere complete and ready to file. The courts have specific requirements and formatting requirements, which is why there are paralegal services and legaldocument preparation services.
In subsequent emails, Caneisha claims she spent too much time researching the motion (and not writing the motion). Just as lawyers specialize in areas of law, it appears that Caneisha's experience is in family law. My case for breach of contract and construction negligence. It appears she tried to copy text from other summary judgments, and it just didn't read well and was incomplete with large sections in RED font.
First, Caneisha never should have taken the job if she was unfamiliar with this area of law and had no prior experience. Second, it is clear from the emails that Caneisha never even started writing until days after the 30-day delivery deadline. Cramming the motion in a couple of days with a partial draft was a recipe for disaster.
